Terms of Sale and Service.

1Definitions

“Materials” or “Products” — the digital files, printable resources, and written content we make available on the Site, whether free or paid, including the wheel, the definitions, the moments, the lists, and the practices. Each individually titled item (for example, but not limited to, The Feelings Wheel, The Feeling Cards, Match It, Name It, and Sit With It) is its own Product, whether purchased on its own or together with other Products.

“Files” — the digital files you download.

“Practitioner” — an individual professional who serves their own clients or patients through a personal professional practice — for example a therapist, counselor, clinician, coach, chaplain, or social worker.

“Practice” — the individual Practitioner’s own professional practice through which they personally serve their own clients.

“License Term” — the period for which the reproduction license is valid: for so long as the Practitioner maintains an active Practice, unless earlier terminated for breach (see Section 4).

2What we sell, and how

Everything on the Site is an instant digital download — a file you download and keep. Nothing physical ships.

Some Materials are free, offered with no account, no email, and no checkout.

Paid Products are sold and delivered through our third-party checkout provider, Payhip. When you buy, Payhip collects your email and payment details on its own platform under its own terms; we never see your card number. See our Privacy Policy.

Prices are shown in US dollars and may change. The price shown at checkout is the price that applies.

3Ownership and intellectual property

The Materials are original work owned by Creative Xpression LLC and protected by copyright. The seven core feelings come from the basic-emotion tradition in psychology, which is not ours; the branching, the wording, the definitions, the moments, the lists, and the practices are ours.

Except for the reproduction license granted in Section 4, the Materials may not be reproduced, copied, distributed, resold, or placed behind another paywall without our written permission. All rights not expressly granted are reserved to Creative Xpression LLC.

4Reproduction license for practitioners

Grant. When you purchase a Product, we grant you a limited, non-sublicensable, non-exclusive, non-transferable, revocable license to reproduce that Product for use with your own clients, subject to complete compliance with these Terms.

Term. This license runs for the License Term: for so long as you maintain an active Practice, unless it is earlier terminated because you breach these Terms. Notwithstanding the foregoing, Creative Xpression LLC may terminate these Terms at its discretion at any time.

Scope.

• Print freely — as many printed copies as you need for your own clients.
• One license, one practitioner. The license is personal to you as an individual Practitioner. A Practice with several practitioners needs one license for each.
• Printed copies may be given to your own clients. The original Files may not be given, sent, shared, sublicensed, or transferred to anyone.
• No resale or redistribution. You may not resell, sublicense, redistribute for commercial gain, or place the Materials — printed or digital — behind another paywall.
• Reservation. We may revoke this license if you breach these Terms. All rights not expressly granted are reserved.
• Each Product carries its own license. If you purchase more than one Product — individually, or together as part of a bundle — you receive a separate reproduction license for each Product included in that purchase, on the same terms as if you’d purchased it on its own.
• Refunds. If you’re refunded for a Product under our returns policy, the license for that Product ends; licenses for any other Product in the same purchase are unaffected.

Free Materials may be printed and used for your personal use or with your own clients, on the same restrictions above (no resale, no redistribution of the original Files for commercial gain, no paywalling).

5Returns and refunds

Because these are instant digital downloads, we don’t offer refunds once a file has been downloaded — downloading a file completes delivery. If a download won’t open, or you were charged in error, email us within 14 days at theforlifeseries@gmail.com and we’ll re-send the file or refund you. This policy is shown before you buy and you confirm it at checkout. Nothing here affects any rights you have that cannot be waived under applicable law.

6Not advice; the nature of the Materials

The Materials are for general informational and educational purposes only. Nothing on the Site or in the Materials is medical, psychological, therapeutic, legal, or financial advice, and nothing is a substitute for professional care.

We are not licensed clinicians, and using the Site creates no therapeutic, professional, or fiduciary relationship.

The wheel, the definitions, and the questions are editorial work. They are not a clinical screening tool, not a diagnostic instrument, and not the Willcox Feeling Wheel or the CNVC Feelings Inventory.

The Site is not a crisis service. If you or someone else is in danger, use the crisis resources listed on the Site (in the US, 988) or your local emergency number.

Some Materials address sensitive experiences — for example bereavement, illness, leaving military service, or recognizing past abuse. They are offered as support, never as treatment, and never ask you to recount anything. If anything makes you feel worse rather than steadier, stop and reach a professional you can get to.

7“As is”; no warranties

The Site and the Materials are provided “as is” and “as available,” without warranties of any kind, whether express or implied — including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that any Material will meet your needs or produce any particular outcome.

8Limitation of liability

To the fullest extent permitted by law, Creative Xpression LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of — or inability to use — the Site or the Materials, even if we have been advised of the possibility. To the fullest extent permitted by law, our total liability for any claim relating to the Site or the Materials will not exceed the greater of the amount you paid us for the Product giving rise to the claim or US $100. Nothing in this section limits liability for personal injury or death, for fraud, gross negligence, or willful misconduct, or for any other liability that cannot be limited or excluded under applicable law.

9Privacy

How we handle data is described in our Privacy Policy, which forms part of these Terms. In short: we store nothing about you on our own servers; the only personal information involved is the email and payment details you give Payhip at checkout.

10Changes to these Terms

We may update these Terms from time to time, at our sole discretion. The version that applies to your purchase is the one posted on the Site at the time you buy.

11Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located in Henrico County, Virginia.
